DECISION & ORDER ON MOTION

Motion by the attorney assigned to represent the appellant by the Family Court, Orange County, to be relieved as counsel for the appellant on an appeal from an order of the Family Court, Orange County, dated December 5, 2012, for poor person relief for the appellant and for the assignment of new counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to be relieved as counsel is denied as unnecessary (see Family Ct Act § 1120); and it is further,

ORDERED that the branches of the motion which are for poor person relief for the appellant and for the assignment of new counsel are denied.
