| DECISION & ORDER ON MOTION |
Application by the appellant-respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect its appeal from an order of the Supreme Court, Kings County, dated August 9, 2012.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the appellant-respondent's time to perfect its appeal is enlarged until May 24, 2013, and the appellant-respondent's appendix including its notice of appeal and any papers necessary to review its appeal, and the appellant-respondent's brief must be served and filed on or before that date; and it is further,
ORDERED that on the Court's own motion Old Republic National Title Insurance Company shall serve and file its brief in response to the brief of the appellant-respondent on or before June 28, 2013; and the appellant-respondent shall serve and file its reply brief on or before July 15, 2013; and it is further;
ORDERED that the parties shall pay their pro rata share of any appendices filed in connection with the appeals in accordance with 22 NYCRR 670.8[C][1].
