DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the Supreme Court, Kings County, rendered February 15, 2011, to direct the respondent to file color copies of the photographs admitted into evidence at trial and to direct the clerk of the Supreme Court, Kings County, to provide a copy of the typewritten transcripts of the stenographic minutes to the respondent, without charge.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to direct the respondent to file color copies of the photographs admitted into evidence at trial is granted and the respondent shall file the subject color copies with the Clerk of this Court at the time that the respondent files a brief; and it is further,

ORDERED that the branch of the motion which is to direct the clerk of the Supreme Court, Kings County, to provide a copy of the typewritten transcripts of the stenographic minutes to the respondent is denied and the appellant's counsel is directed to provide the transcripts to the respondent in accordance with the decision and order on motion of this Court dated September 20, 2011.
