| DECISION & ORDER ON MOTION |
Motion by First Central Savings Bank for leave to appeal to this Court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated October 11, 2012, which reversed, insofar as appealed from, a judgment of the District Court of Suffolk County, Fifth District, entered September 22, 2010, and, inter alia, to enjoin Jose Yglesia from withdrawing certain money deposited for use and occupancy, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
