The People of the State of New York, Respondent, v Robert Nowakowski, Appellant.

Motion by appellant for, among other things, leave to reargue an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered September 18, 2008, which appeal was determined by decision and order of this court dated February 16, 2011 (30 Misc 3d 138[A], 2011 NY Slip Op 50216[U], lv denied 16 NY3d 898 [2011]). Application by appellant for a writ of error coram nobis to vacate, on the ground of the ineffective assistance of appellate counsel, the decision and order dated February 16, 2011.

Upon the papers filed in support of the motion and the application, and the papers filed in opposition thereto, it is

ORDERED that the motion and the application are denied.
