The People of the State of New York, Respondent, v Daniel Azizian, Appellant.

Motion by the appellant on an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered January 12, 2012, to vacate the order of dismissal of January 14, 2013 and for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied as moot. A prior motion to vacate the dismissal was granted by decision and order dated March 11, 2013.
