DECISION & ORDER ON MOTION

Motion by the respondent on appeals from an order of the Supreme Court, Orange County, dated August 17, 2012, in effect, to file only one copy of his brief and to direct the Clerk of the Court to serve his brief on the appellants, and separate motion by the respondent, inter alia, to have him produced at the Appellate Division, Second Department, for oral argument.

Upon the papers filed in support of the motion to file only one copy of the respondent's brief and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion to produce the respondent at the Appellate Division, Second Department, and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion, in effect, to file only one copy of the respondent's brief and to direct the Clerk of the Court to serve the respondent's brief on the appellants, is granted, and the brief previously submitted to the Court is accepted for filing; and it is further,

ORDERED that the Clerk of the Court, or her designee, shall serve one copy of the respondent's brief on each of the appellants; and it is further

ORDERED that the motion, inter alia, to produce the respondent at the Appellate Division, Second Department, for oral argument is denied.
