Motion by the appellants on appeals from two judgments of the Supreme Court, Rockland County, dated July 11, 2012, and September 10, 2012 (Appellate Division Docket Nos. 2012-08347, 2012-11030), respectively, to consolidate those appeals with appeals from two judgments of the same court, both dated July 11, 2012, and two judgments of the same court, both dated September 10, 2012, or, in the alternative, to calendar the appeals together. Application by the respondent Scenic Development, LLC, for a preference in the calendaring of all the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to consolidate the appeals is denied; and it is further,
ORDERED that the branch of the motion which is to calendar the appeals together is granted and the appeals will be argued or submitted on the same day; and it is further,
ORDERED that the application is denied without prejudice to making a motion for that relief.
