| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to reargue appeals from an order of the Supreme Court, Queens County, entered October 12, 2010, and an order of the same court dated January 27, 2011, respectively, which were determined by decision and order of this Court dated December 26, 2012, to modify the award of costs set forth in the order dated December 26, 2012, or to stay the award of costs pending determination of an appeal to the Court of Appeals from the order dated December 26, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay the award of costs pending determination of an appeal to the Court of Appeals from the order dated December 26, 2012, is denied as academic; and it is further,
ORDERED that the motion is otherwise denied.
