DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78 in the nature of mandamus. By decision and order on motion dated November 5, 2012, the petitioner's motion for poor person relief was denied and the petitioner was given 120 days to pay the filing fee or the proceeding would be dismissed. More than 120 days have passed and the filing fee has not been paid.

Now, on the Court's own motion, it is

ORDERED that the proceeding is dismissed, without costs or disbursements.
