Respondent having moved for an extension of time to file and serve an answer and a respondent's brief on this CPLR article 78 proceeding commenced in this Court, and
Petitioner having cross-moved for the opportunity to file and serve a reply brief,
Now, upon reading and filing the affirmation of Frank Brady, Esq., dated March 26, 2013, and the affidavit of David D. Spoto, Esq., sworn to April 2, 2013, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve an answer is granted on the condition that the answer is filed and served on or before April 29, 2013, and the Clerk is directed to accept the answer for filing, and
It is further ORDERED that the motion insofar as it seeks an extension of time to file and serve a respondent's brief is granted on the condition that the brief is filed and served on or before June 7, 2013, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that a reply brief, if any, shall be filed and served on or before June 24, 2013, and
It is further ORDERED that the cross motion is dismissed as unnecessary.
