DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, to stay enforcement of an order of the Family Court, Kings County, dated April 4, 2013 , pending hearing and determination of an appeal from the order.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that the mother's continued care and custody of the subject child is conditioned on the maternal grandmother monitoring the mother's care and custody of the child at all times and the appellant visiting the mother's home twice per week on no less than two hours notice, pending hearing and determination of the appeal, on condition that the appeal is perfected on or before May 17, 2013, and the motion is otherwise denied; and it is further,

ORDERED that in the event the appeal is not perfected on or before May 17, 2013, the Court, on its own motion, may vacate the stay, without further notice, or the respondents may move to vacate the stay, on three days notice.
