Motion by the appellant to vacate an order of this court dated February 11, 2013, which dismissed a judgment of the District Court of Nassau County, Second District entered February 16, 2011, and, in effect, to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is hereby,
ORDERED that the application is granted, and the court's order dismissing the appeal is vacated; and it is further,
ORDERED that on the court's own motion, the appellant's brief shall be served and filed on or before May 16, 2013.
