Motion by the appellant to vacate an order of this court dated February 11, 2013, which dismissed an appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered February 2, 2012.
Upon the papers filed in support of the motion and the papers filed in response thereto, it is
ORDERED that the motion is granted the court's order dismissing the appeal is vacated; and it is further,
ORDERED on the court's own motion, that the time to file appellant's brief is hereby enlarged and appellant' s brief shall be served and filed on or before May 3, 2013.
