Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Westchester County, entered June 20, 2012, as academic, or, in the alternative, to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dismiss an appeal is granted and the appeal is dismissed, without costs or disbursements (see Matter of Ortiz v Alexander, 83 AD3d 1078); and it is further,

ORDERED that the motion is otherwise denied as academic.
