DECISION & ORDER ON MOTION

Motion by the appellant to enjoin the respondents S & A Petroleum Group, Inc., and Ali Yuzbasioglu from conducting demolition work or construction at the subject premises and to enjoin, among others, the Town of East Hampton Building Inspector from issuing a demolition permit or building permit for the subject premises, pending hearing and determination of an appeal from a judgment of the Supreme Court, Suffolk County, entered December 28, 2012.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
