DECISION & ORDER ON MOTION

Motion by the respondents Chunk Ok Lee and Kyung Hee Lee for leave to file a supplemental record on an appeal from an order of the Supreme Court, Kings County, dated August 3, 2012, and to replace certain photographs in the copies of the record on file with this Court. Separate applications by the respondents pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the applications, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and on or before May 29, 2013, the respondent shall file a supplemental record containing the affirmation of Ronald P. Berman dated April 10, 2012, and the reply affirmation of Stephen E. Kwan dated August 1, 2012, and replace the photographs contained on pages 268 and 571 of the record on appeal with the photographs annexed to the motion papers as exhibits D and E; and it is further,

ORDERED that the applications are granted, the applicants' time to serve and file their respective briefs is enlarged until June 28, 2013, and the applicants' briefs must be served and filed on or before that date.
