| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Surrogate's Court, Kings County, dated December 15, 2011, to direct the Clerk of the Surrogate's Court, Kings County, to file the original papers constituting the record on the appeal with the Clerk of this Court.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and on or before May 29, 2013, the Clerk of the Surrogate's Court, Kings County, is directed to file the original papers constituting the record on the appeal with the Clerk of this Court, in accordance with the prior subpoenas issued by the Clerk of this Court; and it is further,
ORDERED that the appellant is directed to serve a copy of this decision and order on motion on the Clerk of the Surrogate's Court, Kings County, on or before May 20, 2013.
