Motion by respondent on an appeal from a decision of the Civil Court of the City of New York, Queens County, dated June 15, 2011, for the release of funds on deposit.
Upon the papers filed in support of the motion, including a stipulation of settlement dated December 18, 2012, and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the New York City Department of Finance is directed to release the funds on deposit in this matter to respondent Valar Realty, LLC, less any lawful fees; and it is further,
ORDERED, on the court's own motion, that the appeal is marked withdrawn pursuant to the stipulation dated December 18, 2012.
