DECISION & ORDER ON MOTION

Appeal by Bank of America from an order of the Supreme Court, Kings County, dated May 7, 2012. By order to show cause dated April 8, 2013, the appellant was directed to show cause before this Court why an order should or should not be entered dismissing the appeal on the ground that it had been rendered academic.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.
