DECISION & ORDER ON MOTION

Motion by the appellant for summary reversal on an appeal from an order of the Family Court, Kings County, dated July 18, 2012, for a reconstruction hearing with respect to the transcripts of certain proceedings and, in effect, to extend his time to comply with the decision and order on motion of this Court dated January 22, 2013.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion which are for summary reversal and for a reconstruction hearing are denied; and it is further,

ORDERED that the branch of the motion which is, in effect, to extend the appellant's time to comply with the decision and order on motion dated January 22, 2013, is granted to the extent that on or before June 13, 2013, the appellant shall file in the office of the Clerk of this Court an affidavit or affirmation stating the date that the transcript has been paid for and the date by which the transcript is expected; and it is further,

ORDERED that if the appellant fails to provide the affidavit or affirmation as set forth above, the Clerk of the Court shall issue an order to all parties to the appeal to show cause why the appeal should or should not be dismissed.
