DECISION & ORDER ON MOTION

Motion by Christopher Otigho pursuant to CPL 460.30 for an extension of time to take an appeal from a judgment of the Supreme Court, Kings County, rendered April 18, 2011, and for leave to prosecute the appeal as a poor person, and for the assignment of counsel. Application by Christopher Otigho to deem the motion to be an application for a writ of error coram nobis.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that the application is denied without prejudice to making a formal application for a writ of error coram nobis.
