On the Court's own motion, it is

ORDERED that the decision and order on motion of this Court dated February 15, 2013, in the above-entitled appeal from an order of the Supreme Court, Suffolk County, dated April 23, 2012, is amended by deleting from the second paragraph thereof the words "no papers having been filed" and substituting therefor the words "the papers filed."
