Respondent Erie County Department of Health having moved for an extension of time to file and serve a brief on the appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Erie on June 1, 2012,
Now, upon reading and filing the affidavit of Kenneth R. Kirby, Esq., sworn to April 30, 2013, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered April 16, 2013, is hereby amended by deleting the date May 31, 2013, and inserting in its place the date June 28, 2013, and
It is further ORDERED that the second ordering paragraph of the order entered April 16, 2013, is hereby amended by deleting the date June 17, 2013, and inserting in its place the date July 15, 2013.
