| DECISION & ORDER ON MOTION |
Motion by the appellants to stay the trial in the above-entitled action, pending hearing and determination of an appeal from an order of the Supreme Court, Queens County, entered July 27, 2012. Separate motion by the appellants for leave to file a supplemental record containing the memorandum of law of David Rutherford and L. Diana Mulderig dated March 28, 2012, and to enlarge the time to serve and file a reply brief.
Upon the papers filed in support of the motions, no papers having been filed in opposition or in relation to the motion to stay the trial, and the papers filed in opposition to the motion for leave to file a supplemental record and to enlarge the time to serve and file a reply brief, it is
ORDERED that the motion to stay the trial is denied; and it is further,
ORDERED that the motion for leave to serve and file a supplemental record and to enlarge the time to serve and file a reply brief is granted, and on or before June 19, 2013, the appellants shall serve and file a supplemental record containing the memorandum of law of David Rutherford and L. Diana Mulderig dated March 28, 2012, and the reply brief.
