DECISION & ORDER ON MOTION

Motion by 405 Hotel, LLC, inter alia, for leave to intervene on an appeal from an order of the Supreme Court, Nassau County, dated June 14, 2012.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted to the extent that the movant is granted leave to serve and file a respondent's brief on the appeal; and it is further,

ORDERED that on or before June 17, 2013, the appellant shall serve a copy of the record and the appellant's brief on 405 Hotel, LLC; and it is further,

ORDERED that 405 Hotel, LLC, shall serve and file its brief on the appeal on or before July 15, 2013; and it is further,

ORDERED that on the Court's own motion, the respondents-respondents' time to serve and file a brief is enlarged until July 15, 2013, and the respondents-respondents' brief, if any, must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that no oral argument by the nonparty-respondent shall be permitted.
