| DECISION & ORDER ON MOTION |
Motion by the third-party defendant, Striper Mechanical Services, Inc., to strike Point V of the brief filed the respondent Freeport Union Free School District on an appeal from an order of the Supreme Court, Nassau County, dated April 2, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, Point V of the brief filed the respondent Freeport Union Free School District is stricken, and on or before June 21, 2013, the respondent Freeport Union Free School District shall delete the pages containing Point V and the references in the table of contents to Point V in the copies of the briefs filed with the Clerk of the Court, or serve and file a replacement brief that does not contain the stricken material.
