Motion by the appellant, in effect, for leave to reargue his prior motion for reargument of a decision and order of this Court dated February 13, 2013, which affirmed a judgment of the Supreme Court, Kings County, rendered July 21, 2008.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the decision and order on motion of this Court dated April 26, 2013, issued pursuant to CPL 460.20, is recalled and vacated.
