| DECISION & ORDER ON MOTION |
Motion by the respondent, inter alia, to reinstate an appeal from an order of the Supreme Court, Nassau County, dated January 23, 2012, and to vacate a stipulation of discontinuance of the underlying action.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to reinstate the appeal is denied as the respondent lacks standing to seek that relief; and it is further,
ORDERED that the branch of the motion which is to vacate the stipulation of discontinuance of the underlying action is denied without prejudice to seeking relief in the Supreme Court, Nassau County; and it is further,
ORDERED that the motion is otherwise denied as academic.
