On the Court's own motion, it is
ORDERED that the decision and order on motion dated June 10, 2013, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the appellant to transfer venue of an appeal from a judgment of the District Court, Nassau County, rendered December 21, 2012, to the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and the appeal is transferred to the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts; and it is further,
ORDERED that all further proceedings in connection with this appeal shall be conducted pursuant to the rules of the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts.
