Appeal from a judgment of conviction of the Criminal Court of the City of New York, Richmond County, rendered August 21, 2007. The notice of appeal was filed on September 24, 2007.

On the court's own motion, it is

ORDERED that the parties show cause before this court why the above-entitled appeal should or should not be dismissed as untimely (see CPL 460.10), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before June 26, 2013; and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties' attorneys by regular mail.
