It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that respondent-respondent's motion to dismiss the appeal is granted, unless petitioner-
appellant perfects his appeal by no later than the October 2013 term - the filing deadline is August 7, 2013. In the event of petitioner-appellant's failure to comply with the foregoing condition, respondent-respondent may move, on five days' notice, for an order dismissing the appeal.
