The People of the State of New York, Respondent, v Khurshid Saleem, Appellant.

Appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered March 6, 2013. The notice of appeal is dated May 3, 2013.

On the court's own motion, it is

ORDERED that the parties are directed show cause before this court why the above-entitled appeal should or should not be dismissed as untimely (see CPL 460.10; 460.30), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before July 3, 2013; and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause upon appellant at his last known place of residence, or, if he is imprisoned, at the institution in which he is confined, and upon the District Attorney, by ordinary mail pursuant to CPL 470.60 (2).
