DECISION & ORDER ON MOTION

Motion by David P. Read for leave to appeal to this Court from an order of the Supreme Court, Rockland County, entered April 17, 2013, and for poor person relief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as the plaintiff is not aggrieved by an order which states that it grants a "motion by the plaintiff for summary judgment" (see CPLR 5511); and it is further,

ORDERED that the motion is otherwise denied as academic.
