In the Matter of Solomon Palmer, respondent,

v Anthony Hayes, appellant.

(Docket No. O-6095-13)

DECISION & ORDER ON MOTION

Appeals by Anthony Hayes from two orders of the Family Court, Kings County, both dated May 23, 2013.

On the Court's own motion, it is

ORDERED that the appeal from the order under Appellate Division Docket No. 2013-06457, which, inter alia, directed the parties to appear for a dispositional hearing, is dismissed, without costs or disbursements, as no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 8 (see Family Ct Act § 1112), and leave to appeal has not been granted.

MASTRO, J.P., AUSTIN, ROMAN and MILLER, JJ., concur.
