Appeal from an order of the Civil Court of the City of New York, Kings County, entered April 5, 2011. By order to show cause dated May 23, 2013, the parties were directed to show cause before this court why an order should or should not be made and entered dismissing the appeal on the ground that the notice of appeal was untimely.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed (see CPLR 5513).
