Irene R.L. Pelled, Respondent, v Roger Hoyes and Caribbean Tours Specialists, Inc., Appellants.

Motion by appellant Roger Hoyes for a stay pending the determination of an appeal from a judgment of the District Court of Nassau County, Fourth District, entered December 2, 2012.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted on condition that the appeal be perfected by September 6, 2013 and on the further condition that appellant Roger Hoyes deposit the sum of $2,157.66 within 10 days of the date of this decision and order; and it is further,

ORDERED that in the event that any the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
