DECISION & ORDER ON MOTION

Motion by the appellant, in effect, to reargue his prior motion for leave to prosecute an appeal from a judgment of the Supreme Court, Westchester County, entered January 16, 2013, as a poor person, including waiver of the filing fee, and to enlarge the record, which was determined by decision and order on motion of this Court dated May 10, 2013.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
