DECISION & ORDER ON MOTION

Motion by the assigned counsel for the appellant on an appeal from a judgment of the County Court, Rockland County, rendered November 15, 2012, to be relieved and to assign new counsel to prosecute the appeal. The appellant's motion for poor person relief and the assignment of counsel was granted by decision and order on motion of this Court dated April 23, 2013, and the following attorney was assigned to prosecute the appeal:

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that on the Court's own motion the appeal in the above-entitled action and the motion to relieve assigned counsel are transferred to the Appellate Division, First Department, for hearing and determination; and it is further,

ORDERED that all further proceedings in connection with this appeal shall be conducted pursuant to the rules of the Appellate Division, First Department.
