| DECISION & ORDER ON MOTION |
Motion by Joseph Katzoff and Shimon Herz for leave to appeal to this Court from two orders of the Supreme Court, Kings County, both dated May 6, 2013, and to stay all proceedings in the above-entitled matter, including the resumption of the evidentiary hearing on the motion to hold them in contempt, pending hearing and determination of the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal from so much of the orders as directed the resumption of a hearing with the cross examination of witness Bruce Karp to determine the motion to hold Joseph Katzoff and Shimon Herz in contempt is denied; and it is further,
ORDERED that the branch of the motion which is for leave to appeal from the remaining portions of the orders is denied as unnecessary (see CPLR 5701); and it is further,
ORDERED that the branch of the motion which is to stay all proceedings in the above-entitled matter, including the resumption of the evidentiary hearing on the motion to hold Joseph Katzoff and Shimon Harz in contempt, is denied.
