DECISION & ORDER ON MOTION

Motion by the appellant Moinuddin Ahmed on appeals from two orders of the Supreme Court, Orange County, both dated July 20, 2012, inter alia, to adopt Point II of the brief filed by the appellants Rose Aumick, Bon Secours Community Hospital, and Bon Secours Charity Health System. Application pursuant to 22 NYCRR 670.8(d)(2) to enlarge the appellants' time to serve and file their respective reply briefs.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted to the extent that on or before September 3, 2013, the appellant Moinuddin Ahmed may serve and file a supplemental brief raising the issue of excessive damages, and the respondent may file a response to the supplemental brief on or before October 3, 2013, and the motion is otherwise denied; and it is further,

ORDERED that the application is granted and the appellants' time to serve and file their respective reply briefs is enlarged until October 18, 2013, and the reply briefs shall be served and filed on or before that date.
