Appeal by Theodore Lobe from an order of the Family Court, Kings County, dated January 2, 2013. By decision and order on motion of this Court dated May 29, 2013, the appellant was directed to file an affidavit or affirmation in the office of the Clerk of this Court containing certain information on or before June 28, 2013. The appellant failed to file the affidavit or affirmation.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion of this Court dated May 29, 2013 (see 22 NYCRR 670.4[a][2]).
