Motion by appellant for leave to reargue so much of an appeal as was from a judgment of the Justice Court of the Town of Putnam Valley, Putnam County, rendered January 13, 2011, convicting appellant of driving while ability impaired, which appeal was determined by decision and order of this court dated April 8, 2013.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
