| DECISION & ORDER ON MOTION |
Motion by the respondent for leave to reargue the appellant's motion to stay the Sheriff's sale of the subject condominium unit, pending hearing and determination of an appeal from an order of the Supreme Court, Nassau County, dated May 14, 2013, which was determined by decision and order on motion of this Court dated June 7, 2013, to allow the respondent to submit opposition to the appellant's motion, and, upon reargument, to vacate the stay of the Sherrif's sale which was granted by the decision and order on motion dated June 7, 2013.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and, upon reargument, the stay granted by the decision and order on motion of this Court dated June 7, 2013, is vacated forthwith.
