Application pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Rockland County, dated November 13, 2012, and to enlarge the time to serve and file the respondent's brief and the appellant's reply brief.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted to the extent that the appellant's time to perfect the appeal is enlarged until November 1, 2013, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date, the application is otherwise denied as premature, and the parties shall serve and file the respondent's brief and the appellant's reply brief, if any, in accordance with the rules of this Court (see 22 NYCRR 670.8[b]), without prejudice to making an application pursuant to 22 NYCRR 670.8(d)(2) to extend the time to serve and file those briefs.
