| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the judgment roll on an appeal from a judgment of the County Court, Nassau County, rendered December 7, 2010, to include certain documents.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the record to include the decision and order on motion of this Court dated May 3, 2011, which granted the appellant's motion pursuant to CPL 460.30 for an extension of time to take an appeal from the judgment, and the trial exhibits and the indictment, is denied as unnecessary as those documents are properly part of the record, and it is further,
ORDERED that the motion is otherwise denied.
