DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, to review the transcript of certain in camera proceedings on an appeal from an order of the Family Court, Richmond County, dated August 10, 2012, in order to determine if the appellant has a meritorious appeal. By order on certification of this Court dated December 4, 2012, the appellant was granted poor person relief and the following attorney was assigned as counsel for the appellant on the appeal:

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, assigned counsel for the appellant is relieved of the assignment and pursuant to Family Court Act § 1120, the following named attorney is assigned as new counsel to prosecute the appeal:

and it is further,

ORDERED that former assigned counsel is directed to turn over all papers in the proceeding to the new counsel herein assigned; and it is further,

ORDERED that the appellant's time to perfect the appeal by causing the original papers constituting the record on the appeal to be filed in the office of the Clerk of this Court (see 22 NYCRR 670.9[d][2]) and by serving and filing a brief on the appeal is enlarged until October 21, 2013; and it is further,

ORDERED that assigned counsel is directed to serve a copy of this order upon the Clerk of the Court from which the appeal is taken; and it is further,

ORDERED that the motion is denied as academic.
