DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Jermaine Jones, Appellant.

Motion by appellant on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered October 19, 2012, to continue, pending the determination of the appeal, a stay of execution of the judgment, which was granted by the Supreme Court, Kings County, on December 3, 2012.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is granted and the stay of execution of the judgment is extended pending the determination of the appeal on condition that the appeal be perfected by December 6, 2013; and it is further,

ORDERED that the stay shall terminate and be of no further effect unless the appeal is perfected on or before December 6, 2013; and it is further,

ORDERED that appellant's counsel shall serve a copy of this order, by mail, on the clerk of the court from which the appeal is taken.
