Defendant having moved for a writ of error coram nobis assigning counsel to perfect appeals from the order of Supreme Court, Monroe County, dated June 27, 2013, and the resentence of Supreme Court, Monroe County rendered January 8, 2010,
Now, upon reading and filing the affidavit of Reggie D. Caswell sworn to July 29, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied without prejudice.
Memorandum: Appellate review of Supreme Court, Monroe County order dated June 27, 2013 must be pursued by filing a CPL 460.15 application. Defendant may seek assignment of counsel and poor person relief for the appeal taken from the resentence of Supreme Court, Monroe County rendered January 8, 2010 upon the filing and serving a motion pursuant to 22 NYCRR 1000.14.
