Pamela Stein, appellant-respondent, v William Stein, respondent-appellant. (Index No. 202865/02)
| DECISION & ORDER ON MOTION |
Motion by William Stein, inter alia, to stay enforcement of any judgment entered upon an order of the Supreme Court, Nassau County, dated June 3, 2013, pending hearing and determination of his cross appeal from the order, and to dismiss the appeal by Pamela Stein from the order on the ground that no appeal lies from an order denying reargument.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal by Pamela Stein is held in abeyance and referred to the panel of Justices hearing the appeal and cross appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that the motion is otherwise denied.
DILLON, J.P., ANGIOLILLO, LEVENTHAL and LOTT, JJ., concur.
